Mrs. Fields SMS Terms of Service

Use of Famous Brands International (“Mrs. Fields,” “TCBY,” “We,” “Our,” or “Us”) text message-based services (the “Text Services”) is subject to the following Terms of Use. These Terms of Use, in connection with the Privacy Policy, which is incorporated herein by reference, represent a legal agreement. Please read them carefully.

  1. We will allow various opportunities, such as a entering a phone number online, to opt-in to SMS services. The opt-in received may require you to enter your phone number and check a box next to a statement that reads ‘I would like to sign up to receive notifications from Mrs. Fields,’ or similar.
  2. You can cancel or opt-out of the Text Services at any time. Just text “STOP” to COOKIE. After you send the SMS message “STOP” to us, we will send an additional SMS message to you for the purpose of confirming that you have been unsubscribed from the Text Services. After this, you will no longer receive SMS messages from us. If you would like to opt-in to the Text Services again, you may opt-in the same way you did initially, and we will start sending SMS messages to you again.
  3. If at any time you forget what shortcodes are supported, refer back to these Terms of Use or text “HELP” to COOKIE. We will then send an SMS message to you with instructions on how to opt-out.
  4. We are able to deliver messages to the following mobile service providers. Major providers: [AT&T, Verizon Wireless, Sprint, T-Mobile, MetroPCS, U.S. Cellular, Alltel, Boost Mobile, Nextel, and Virgin Mobile]. Minor providers: [Cincinnati Bell Wireless, Cricket, and COX]. Neither your mobile service provider nor Mrs. Fields will be liable for delayed or undelivered messages. Message and data rates may apply to all incoming and outbound SMS messages. You agree that you are solely responsible for any such charges. Please be aware that texting charges can fluctuate internationally. Text messaging rates can normally be found by asking your service provider. All charges are billed by and payable to your mobile service provider.   5. You understand that any third-party with access to your mobile phone may be able to view the messages you send or receive when using the Text Services, and you agree that we will not be liable to you if this occurs. You understand that you are not required to consent to the Text Services to use Our site, including mobile sites or apps (collectively, the “Sites”), or receive any other services from us.
  6. You represent and warrant that all communications you cause to be sent through the Text Services shall at all times comply with all applicable local, state and federal laws and regulations, including, but not limited to, the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the CAN-SPAM Act, and all other laws and regulations concerning privacy, telemarketing, and the sending of SMS text messages.
  7. By agreeing to these Terms of Use and providing us with your mobile phone number when you opt-in to the Text Services, you authorize us to contact you by text message via your mobile phone number using an automatic telephone dialing system or device, or any other computer assisted technology as applicable.
